A BILL FOR AN ACT

 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The Hawaii Revised Statutes is amended by adding four new sections to be appropriately designated and to read as follows:

     "§321-A  Producers of hand-pounded poi; exemption.  A producer of hand-pounded poi shall not be required to process poi in a certified food processing establishment or be required to obtain a permit from the department of health, if the producer:

     (1)  Sells hand-pounded poi directly to consumers;

     (2)  Attends a food-safety class;

     (3)  Prepares hand-pounded poi adjacent to permanent or temporary hand-washing facilities; and

     (4)  Labels each batch of hand-pounded poi with:

         (A)  The name and address of the producer;

         (B)  The statement, "This hand-pounded taro product was not prepared in a Department of Health-approved facility and may increase your risk of food-borne illness" in clear and conspicuous print.

     §321-B  Poi; storage; serving or selling.  Naturally fermenting poi kept at an ambient temperature may be served or offered for sale in a ready-to-eat form upon the request or with the knowledge of the consumer.

     §321‑C  Producers of hand-pounded poi; cease-and-desist notice.  If the department of health receives complaints relating to concerns about public health, particularly complaints about food-borne illnesses, the department may, subject to chapter 91, issue a cease-and-desist notice to terminate any distribution or sale of the hand-pounded poi product in question.

     §321-D  Definitions.  As used in sections 321-A and 321-D:

     "Hand-pounded" means processed with papa kui ai and pōhaku kui ai and without the use of machines or machinery.

     "Hand-pounded poi" means poi that is produced by hand using customary and traditional Hawaiian cultural food-preparation practices.

     "Papa kui ai" means a poi-pounding board.

     "Pōhaku kui ai" means a poi-pounding stone."

     SECTION 2.  In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on January 1, 2050.

Description:

Exempts the preparation of hand-pounded poi from certain Department of Health (DOH) requirements regarding food safety.  Imposes labeling requirements on hand-pounded poi not made in approved food-processing facilities.  Authorizes DOH to conduct inspections under certain circumstances.  Effective January 1, 2050.  (SB101 HD1)
