HOUSE RESOLUTION

 

 

strongly urging the pest control board to develop standards for pest control operators and termite inspection reports, and to adopt those standards prior to the convening of the 2013 Regular session of the hawaii legislature.

 

 

 


     WHEREAS, section 460J-19, Hawaii Revised Statutes, sets forth requirements for contracts for the control of termites and written inspection reports; and

 

     WHEREAS, it is a violation of the pest control law under section 460J-15(a)(5), Hawaii Revised Statutes, to, among other things, furnish a report of inspection without the making of a bona fide inspection of the premises for termites; and

 

     WHEREAS, there are few industry standards that provide guidance as to the standards to be used by Hawaii pest control operators in conducting a termite inspection; and

 

     WHEREAS, standards relating to termite inspections will assist licensees by clarifying the procedures and standards to be applied when conducting a termite inspection; and

 

     WHEREAS, standards relating to termite inspections will assist the Pest Control Board and the Regulated Industries Complaints Office in evaluating complaints relating to possible violations of Hawaii pest control law; and

 

     WHEREAS, the Pest Control Board is currently contemplating rule revisions including, but not limited, to proposed rules relating to termite inspection standards; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, that the Pest Control Board is strongly urged to develop standards for pest control operators and termite inspection reports, and to adopt those standards prior to the convening of the 2013 Regular Session; and

 

     BE IT FURTHER RESOLVED that in developing standards for termite inspection reports, the Pest Control Board should consider input from interested parties including, but not limited to, representatives from the pest control industry as well as from interested members of the public; and

 

     BE IT FURTHER RESOLVED that the Pest Control Board is strongly urged to submit a progress report on rules relating to pest control operators and termite inspection report standards no later than 20 days prior to the convening of the 2012 Regular Session; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Chairperson of the Pest Control Board, Complaints & Enforcement Officer of the Regulated Industries Complaints Office, and the Director of Commerce and Consumer Affairs.
