HOUSE RESOLUTION

 

 

Urging the counties to assess, impose, levy, and collect AN additional FIVE PERCENT impact fee ON the development COST of housing units priced at or above $700,000 to be deposited into a special fund to develop parks for homeless persons.

 

 

 


     WHEREAS, in spite of efforts by governments and nonprofit organizations to provide overnight shelter to homeless persons, many do not use homeless shelters due to mental illness, drug addiction, an inability to conform to shelter rules, or other reasons; and

 

     WHEREAS, there are still many homeless persons who sleep in parks, along sidewalks, and other public areas; and

 

     WHEREAS, homeless persons who sleep in public areas create a grave concern for the State, particularly for the vital visitor industry; and

 

     WHEREAS, funding is needed to establish new parks or designate existing parks for use by homeless persons; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, that in addition to current impact fees authorized under section 46-142, Hawaii Revised Statutes, the counties are urged to assess, impose, levy, and collect additional impact fees in the amount of five percent of the cost of development of single, duplex, or multi-family housing units that are priced at or above $700,000 to be deposited into a special fund for use by the Hawaii Public Housing Authority to develop parks for homeless persons; and
     BE IT FURTHER RESOLVED that moneys in the special fund for developing parks for homeless persons be used to establish new parks or designate existing parks for use by homeless persons that:

 

     (1)  Provide pavilions with open walls and shelter over head;

 

     (2)  Provide showers and toilets;

 

     (3)  Provide potable water;

 

     (4)  Provide coin-operated clothes drying and washing machines;

 

     (5)  Allow camping at night only; and

 

     (6)  Allow homeless persons to bring in a limited amount of possessions and a maximum of one pet as appropriate;

 

and

 

     BE IT FURTHER RESOLVED the counties are urged to refund any of the additional impact fees transferred to the special fund for developing parks for homeless persons that have not been expended or encumbered within ten years after collection; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Governor, Mayors and Council members of the counties of Kauai, Maui, Hawaii, and the City and County of Honolulu.
