HOUSE CONCURRENT

RESOLUTION

 

 

Requesting that the hawaii community development authority retain the kakaako reserved housing rules in their current, unamended form.

 

 

 


     WHEREAS, on November 11, 2011, chapter 15-218, Hawaii Administrative Rules, entitled "Kakaako Reserved Housing Rules", became effective, replacing chapter 15-22, Hawaii Administrative Rules, "The Mauka Area Rules" of the Hawaii Community Development Authority; and

 

     WHEREAS, pursuant to section 15-218-1, Hawaii Administrative Rules, the purpose and intent of the Kakaako Reserved Housing Rules "is to establish an increased supply of housing for residents of low- or moderate-income within the Kakaako community development district"; and

 

     WHEREAS, section 15-218-17, Hawaii Administrative Rules, requires that certain new developments or redevelopments within the Kakaako community development district designate at least twenty percent of the total residential floor area as reserved housing units, or designate fifteen percent of the total residential floor area as reserved housing units if the units of a new development or redevelopment are developed as rental units; and

 

     WHEREAS, the Kakaako Reserved Housing Rules are administered by the Hawaii Community Development Authority, which now seeks to amend the rules; and

 

     WHEREAS, the Legislature objects to the proposed rule amendments; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2018, the Senate concurring, that the Hawaii Community Development Authority is requested to retain the Kakaako Reserved Housing Rules in their current, unamended form; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Executive Director of the Hawaii Community Development Authority and the Director of the Department of Business, Economic Development, and Tourism.
