A BILL FOR AN ACT
RELATING TO EDUCATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 465D-4, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) Beginning on
January 1, 2016, except as specifically provided in this chapter, no person
shall engage in the practice of behavior analysis or use the title "licensed
behavior analyst" or "behavior analyst" without a valid license
issued pursuant to this chapter[.]; provided that nothing herein
shall be construed to prevent an individual, including an individual working in
other professions such as school psychologists, teachers, educational
assistants, occupational therapists, school social workers, guidance
counselors, speech-language pathologists, and audiologists, from engaging in
the practice of behavior analysis when the practice of behavior analysis is
done in a public educational setting; provided further that no such individual
shall use any title or description stating or implying that the individual is a
"licensed behavior analyst" or "behavior analyst" without
holding a license pursuant to this chapter."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
