A BILL FOR AN ACT
relating to harbors.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§200- Harbors; small vessel; mooring during inclement
weather and dangerous ocean conditions.
Notwithstanding
any law to the contrary, the department shall allow, on a space available
basis, a small vessel to moor in any harbor under the jurisdiction of the
department at no additional cost and with no use permit required in the event
of inclement weather or ocean conditions; provided that the department shall determine
that the entry and mooring of the small vessel shall be conducted in a safe
manner; and provided further that as soon as the department opens the entrance
to vessels, the small vessel shall leave the harbor.
The chairperson shall adopt rules
pursuant to chapter 91 to implement this section, including requirements for
size and use of a vessel to qualify as a small vessel under this section."
SECTION 2. Chapter 266, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§266- Harbors; small vessel; mooring during inclement
weather and dangerous ocean conditions.
Notwithstanding
any law to the contrary, the department of transportation shall allow, on a
space available basis, a small vessel to moor in any harbor under the
jurisdiction of the department of transportation at no additional cost and with
no use permit required in the event of inclement weather or ocean conditions;
provided that the department of transportation shall determine that the entry
and mooring of the small vessel shall be conducted in a safe manner; and
provided further that as soon as the department of transportation opens the
entrance to vessels, the small vessel shall leave the harbor.
The director of transportation shall
adopt rules pursuant to chapter 91 to implement this section, including
requirements for size and use of a vessel to qualify as a small vessel under
this section."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
