A BILL FOR AN ACT
RELATING TO GENERAL EXCISE TAX.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 237, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§237- Exemption for farmers of fresh farm produce. (a) This chapter shall not apply to payment received by a farmer for the sale of fresh farm produce that is intended for human consumption within the State; provided that the farmer is registered with the department of taxation by submitting a written application for registration in such form as the department of taxation shall prescribe, has paid a registration fee of $ upon initial registration and annually thereafter, and has obtained approval of the exemption from the department of taxation.
This exemption shall not apply to sales of fresh farm produce intended for human consumption outside of the state.
(b) For purposes of this section:
"Farmer" means a person or entity, of whatsoever size, that cultivates the land in the state in order to grow fresh farm produce for human consumption.
"Fresh farm produce" means all fresh fruits and vegetables grown in the soil or hydroponically, whether or not organic, that are sold in the same condition generally as when they were harvested."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act, upon its approval, shall apply to gross income or gross proceeds received after December 31, 2050.
