A BILL FOR AN ACT

 

 

relating to firearms.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 134-2, Hawaii Revised Statutes, is amended by amending subsection (i) to read as follows:

     "(i)  [No fee shall be charged] Each county may establish a fee for permits, or applications for permits, under this section[, except for a single fee chargeable by and payable to the issuing county, for individuals applying for their first permit, in an amount]; provided that any county that does not establish a fee, shall charge a fee equal to the fee actually charged by the Federal Bureau of Investigation to the issuing police department for a fingerprint check in connection with that application or permit.  In the case of a joint application, the fee provided for in this section may be charged to each person [to whom no previous permit has been issued].  Revenue derived from fees collected pursuant to this section shall be appropriated to the issuing county's police department."

     SECTION 2.  Section 134-3, Hawaii Revised Statutes, is amended by amending subsection (e) to read as follows:

     "(e)  [No fee shall be charged] Each county may establish a fee for the registration of a firearm under this section[, except for a fee chargeable by and payable to the registering county]; provided that any county that does not establish a fee, shall charge a fee for persons registering a firearm under subsection (a), in an amount equal to the fee actually charged by the Federal Bureau of Investigation to the registering police department for a fingerprint check in connection with the registration[.]; provided further that no member of the United States military serving on active duty in the State shall be charged a fee pursuant to this section.  In the case of a joint registration, the fee provided for in this section may be charged to each person.  Revenues derived from fees collected pursuant to this section shall be appropriated to the issuing county's police department."

     SECTION 3.  Section 134-9, Hawaii Revised Statutes, is amended by amending subsection (d) to read as follows:

     "(d)  A fee of [$10] $25 shall be charged for each license and shall be deposited in the treasury of the county in which the license is granted."

     SECTION 4.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect on July 1, 2015.
