A BILL FOR AN ACT
relating to harbors.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that Pohoiki bay harbor, at Isaac Hale beach park, is the only harbor in the lower portion of the Puna district of the Island of Hawaii. The harbor includes a one-lane boat ramp and a ninety-foot breakwater. The harbor can only accommodate small boats, and launching them can be difficult because of the harbor's small size and rough ocean conditions that are often present.
The legislature further finds that Kapoho bay, near the eastern tip of the Puna district, is a naturally protected bay where it may be feasible to establish a harbor or port to accommodate vessels that transport cargo and passengers.
Accordingly, the purpose of this Act is to require the director of transportation to contract for the performance of a feasibility study for a harbor or port at Kapoho bay.
SECTION 2. The director of transportation shall contract for a study to determine the feasibility of establishing a harbor or port at Kapoho bay to accommodate vessels that transport cargo and passengers. The department shall submit a report to the legislature with preliminary findings and recommendations, including any proposed legislation, not later than twenty days prior to the convening of the regular session of 2016 and a final report with findings and recommendations, including any proposed legislation, not later than twenty days prior to the convening of the regular session of 2017.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2015-2016 and the same sum or so much thereof as may be necessary for fiscal year 2016-2017 for the purposes of this Act.
The sums appropriated shall be expended by the department of transportation for the purposes of this Act.
SECTION 4. This Act shall take effect on July 1, 2015.
