A BILL FOR AN ACT
relating to the contractors license board.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 444-3, Hawaii Revised Statutes, is amended to read as follows:
"§444-3 Contractors license board.
(a) There shall be a contractors license board of thirteen members[.],
each of whom shall:
(1) Be at least thirty years of age and of good character; and
(2) Have been a resident of, and domiciled in, the State for not less than five years preceding the member's appointment.
(b) Of the board members:
(1) [Ten] Five shall be contractors who
have been actively engaged in the contracting business for a period of not less
than five years preceding the date of their appointment[;
(2) Five] and who hold a valid and
unexpired license to operate as a contractor at the time of appointment. Of
the five contractors, one shall be a general engineering contractor,
[or] two shall be general building contractors, [five] and
two shall be specialty contractors[, and three shall be noncontractors.];
and
(2) Eight shall be noncontractors, as follows:
(A) One shall be a member of a labor organization representing the building trades;
(B) One shall be a representative of a state-approved building and construction trade apprenticeship program pursuant to section 103-55.6;
(C) One shall be a representative from the Hawaii occupational safety and health division of the department of labor and industrial relations; and
(D) Five shall be public members; provided that each public member shall possess a working knowledge of, or have experience with, the construction industry;
provided that no noncontractor shall be a current licensee of the board, a close family member of a licensee, or have any financial interest in the business of any licensee of the board.
No member shall receive any compensation for the member's services, but each shall be reimbursed for necessary traveling expenses incurred in the performance of duties.
(c) Each county shall be represented on the board.
(d) [No one, except the three noncontractor
members, shall be eligible for appointment who does not at the time of the
member's appointment hold a valid and unexpired license to operate as a
contractor.] The protection of the public shall be of the highest
priority for the board in the exercise of its licensing, regulatory, and
disciplinary functions. Whenever the protection of the public is inconsistent
with other interests that are sought to be promoted, the protection of the
public shall take priority.
(e) For the purposes of this section, the terms "general engineering contractor", "general building contractor", and "specialty contractor" shall have the meanings given to them in section 444-7."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval; provided that the present members of the contractors license board shall serve in their capacity until their replacements are appointed by the governor.
