A BILL FOR AN ACT
RELATING TO CAMPAIGN CONTRIBUTIONS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to prohibit the solicitation and acceptance of campaign contributions by legislators during selected periods of legislative sessions.
SECTION 2. Section 11-342, Hawaii Revised Statutes, is amended to read as follows:
"[[]§11-342[]] Fundraiser; notice of intent[.];
when prohibited. (a) No fundraiser shall be held unless
a notice of intent to hold the fundraiser is filed with the commission setting
forth the name and address of the person in charge, the price per person, the
date, hour, and place of the fundraiser, and the method thereof.
(b) [The] For fundraisers subject to
subsection (a), the person in charge of the fundraiser shall file the
notice with the commission prior to the fundraiser.
(c) No legislator, or person employed by or acting on behalf of a legislator, shall hold a fundraiser or receive a contribution, regardless of whether the contribution is made in- person, by mail or internet, or another method, within one week prior to the following deadlines established for each regular session of the legislature by its respective houses:
(1) First lateral filing;
(2) First decking;
(3) Second lateral filing;
(4) Second decking; and
(5) Final decking.
No contribution received during a prohibited period under this subsection shall be used or expended by the legislator and shall be returned to the contributor. If the contributor cannot be identified, the contribution shall escheat to the Hawaii election campaign fund.
[(c)] (d) As used in this
section, "fundraiser" means any function held for the benefit of a
candidate, candidate committee, or noncandidate committee that is intended or
designed, directly or indirectly, to raise contributions for which the price or
suggested contribution for attending the function is more than $25 per person."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2015.
