A BILL FOR AN ACT


 

 

relating to agriculture.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The department of agriculture shall develop and implement a temporary reimbursement program to reimburse qualified tenants, operating on state-leased agricultural lands in vog-impacted areas, for costs incurred by the tenant due to vog in repairing, maintaining, or replacing fencing and other infrastructure on the leased property.  The department of agriculture shall consult with the department of land and natural resources in planning and implementing the program, and may consult with other entities as necessary.    (b)  The department of agriculture shall determine the:

(1)  Vog-impacted areas;

(2)  Procedures and policies in applying for and     administering the program;

(3)  Criteria needed to qualify for the reimbursement     program; and

(4)  Amount of reimbursement for each tenant.

     (c)  The program shall cease to exist on June 30, 2011. 

     SECTION 2.  There is authorized a federal fund ceiling increase of $          for the department of agriculture to accommodate federal funds received under the Homeland Security Grant Program.

     SECTION 3.  There is appropriated out of the federal funds received under the Homeland Security Grant Program the sum of

$       or so much thereof as may be necessary for fiscal year 2009-2010 and the same sum or so much thereof as may be necessary for fiscal year 2010-2011 for the temporary reimbursement program established in this Act.

     The sums appropriated shall be expended by the department of agriculture for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2009.
