A BILL FOR AN ACT

 

 

relating to public safety.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 710, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§710-    Commission of an offense while released on bail; penalty.  (a)  A person commits the offense of commission of an offense while released on bail if the person commits a criminal offense under any federal, state, or local law while released on bail pursuant to chapter 804 or the laws of any other jurisdiction.

     (b)  Commission of an offense while released on bail is a class C felony."

     SECTION 2.  Section 804-7.2, Hawaii Revised Statutes, is amended to read as follows:

     "§804-7.2  Violations of conditions of release on bail, recognizance, or supervised release.  (a)  Upon verified application by the prosecuting attorney alleging that a defendant has intentionally violated the conditions of release on bail, recognizance, or supervised release, the judicial officer named in section 804-5 shall issue a warrant directing the defendant be arrested and taken forthwith before the court [[]of[]] record for hearing.  A law enforcement officer having reasonable grounds to believe that a released felony defendant has violated the conditions of release on bail, recognizance, or supervised release, may, where it would be impracticable to secure a warrant, arrest the defendant and take the defendant forthwith before the court of record.

     (b)  Any person committing a criminal offense under any federal, state, or local law during the period of release on bail shall be guilty of the crime of commission of an offense while released on bail in accordance with section 710-   ."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
