A BILL FOR AN ACT
relating to child support enforcement.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 576D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§576D- Investigations; misuse of child support. (a) The agency shall receive and investigate complaints alleging that a custodial parent has misused child support.
(b) Complaints of the misuse of child support may be filed by:
(1) The child for whom the order of support is issued; or
(2) A guardian ad litem appointed by the court to protect the interests of the child.
(c) Upon the filing of a complaint and for the duration of an investigation by the agency, child support payments made by the obligor shall be held in trust by the agency.
(d) The agency may adopt rules pursuant to chapter 91 to implement this section.
(e) For purposes of this section, "misuse of child support" means the use of child support for purposes other than as set forth in the order of support."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2010.
