A BILL FOR AN ACT

 

 

relating to electronic benefits transfer cards.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to establish procedures to allow the State to have electronic benefits transfer cards to include on the face of the card a photo of the cardholder.

     SECTION 2.  By January 1, 2013, the director of human services shall seek a federal waiver from the United States Department of Agriculture to allow the State to include on the face of every electronic benefits transfer card a photo of the cardholder.

     By January 1, 2013, the state department of human services shall provide the legislature with an estimate of the cost, pursuant to the potential federal waiver, of:

     (1)  Replacing every still-valid electronic benefits transfer card with a card that contains on its face a photo of the cardholder;

     (2)  "Phasing in" new photo identification cards issued under any current contract with any current electronic benefits transfer card vendor; and

     (3)  Implementing photo identification cards pursuant to the federal waiver through a new request for proposals once the contract with any current electronic benefits transfer card vendor expires.

     If the federal waiver is received, the legislature shall determine whether to implement the federal waiver based upon the cost findings.

     SECTION 3.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-    Identification for electronic benefits transfer transactions.  In the absence of a photo of the cardholder on an electronic benefits transfer card, the cardholder shall present photo identification to cashiers at food retailers, bank tellers, or authorized officials at the point-of-sale when making a transaction.  If no photo identification is provided by the cardholder, the transaction may be declined."

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2012.

Requires federal waiver to be sought and cost study to be  conducted regarding the inclusion of the cardholder's photo on electronic benefits transfer cards.  Requires the cardholder whose electronic benefits card lacks a photo to present a photo identification for certain transactions.  Effective July 1, 2012.
