A BILL FOR AN ACT

 

 

RELATING TO CONSTRUCTION WASTE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that it is desirable to enhance the quality of the natural environment by implementing sound practices that reduce negative impacts from building and development projects.  Sustainable construction practices reduce the collective environmental impacts of the construction process, the production of building materials, and the operation and maintenance of the building throughout its lifespan.  Sustainable practices emphasize the preservation of natural resources and the efficient use of construction materials.

     The purpose of this Act is to require the department of health to convene a construction waste reuse and recycling working group to develop recommendations on how to implement a requirement for the reuse, recycling, or donation of construction waste.

     SECTION 2.  (a)  The department of health shall convene a construction waste reuse and recycling working group to determine how to implement a requirement for the reuse, recycling, or donation of construction waste.

     (b)  The working group shall consist of the following members:

     (1)  The director of health, or the director's designee, who shall serve as the chair;

     (2)  The comptroller, or the comptroller's designee;

     (3)  A representative from the environmental service agency of each county, to be appointed by the mayor of the county of the agency;

     (4)  A building industry representative, to be appointed by the senate president;

     (5)  A representative of a non-governmental organization in the reuse and recycling industry, to be appointed by the speaker of the house of representatives;

     (6)  A representative from Re-use Hawaii;

     (7)  A representative from Hawaii Materials Recycling, LLC;

     (8)  The president of the Chamber of Commerce Hawaii, or the president's designee; and

     (9)  A member of the state building code council, to be appointed by the members of the council.

     (c)  Members of the working group shall serve without compensation but may be reimbursed for expenses, including travel expenses, necessary for the performance of their duties.

     (d)  The working group shall submit an interim report of its progress to the legislature no later than twenty days prior to the convening of the regular session of 2021, and a final report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2022.

     (e)  The working group shall cease to exist on June 30, 2022.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2020-2021 for the construction waste reuse and recycling working group to perform its duties pursuant to section 2 of this Act.

     The sum appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2050.
