A BILL FOR AN ACT

 

 

RELATING TO AIR POLLUTION CONTROL.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 342B, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§342B‑    Air pollution standards for crematories.  (a)  Emissions from a crematory shall constitute an air pollutant as defined in section 342B-1 in addition to federal law and department rule designations of air pollutant.

     (b)  Pursuant to section 342B-12, the director shall establish ambient air quality standards specifically for crematories to prohibit emissions that would result in an ambient air concentration of pollutants that may endanger human health or which may unreasonably interfere with the comfortable enjoyment of life and property.

     (c)  For purposes of this section, crematory means an establishment, usually a cemetery or cemetery authority as defined in section 441-1, that contains a furnace used to cremate human remains."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
