A BILL FOR AN ACT

 

 

relating to flood mitigation in manoa valley.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that although numerous communities in Hawaii experience periodic flooding during times of heavy rain, Manoa Valley is particularly susceptible to flooding.  For more than sixty years, the intersection of East Manoa Road and Oahu Avenue has flooded following a downpour, with water levels rising above the curb.  This causes the intersection to become nearly impassable to motor vehicles that may stall in the flooded waters and is hazardous to pedestrians who may be unable to see nearby storm drains or curbs.

     The legislature believes that the intersection of East Manoa Road and Oahu Avenue is a critical thoroughfare since it is the primary entrance into, and exit from, Manoa Valley.  Flooding at the intersection causes traffic congestion, results in blocked roads, and delays police, fire, and emergency medical services from responding to emergencies throughout Manoa Valley.

     The legislature further finds that House Concurrent Resolution 147, Regular Session of 2021, (H.C.R. 147) convened a working group to make recommendations on flood mitigation at the intersection of East Manoa Road and Oahu Avenue.  The working group met, reviewed decades of past solutions which proved to be unviable, and issued a report referencing a solution involving directing excessive waters into underground water storage locations having adequate capacity and in close proximity to the flooded areas, until other flood waters have drained and then pumping the water out of the storage locations to drainage areas.

     The purpose of this Act is to require the city and county of Honolulu to implement flood mitigation in Manoa Valley by implementing the solution referenced by the H.C.R. 147 working group and to provide funding for the capital improvement project.

     SECTION 2.  The legislature declares that the project described in this Act is a capital improvement project that qualifies for a grant-in-aid pursuant to chapter 214, Hawaii Revised Statutes.

     SECTION 3.  The city and county shall implement flood mitigation in Manoa Valley at the intersection of East Manoa Road and Oahu Avenue and nearby locations, as necessary, taking into consideration the idea referenced by the working group convened pursuant to House Concurrent Resolution 147, Regular Session of 2021, to direct excessive waters into underground water storage locations having adequate capacity and in close proximity to the flooded areas, until other flood waters have drained and then pumping the water out of the storage locations to drainage areas.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2022-2023 as a grant-in-aid to the city and county of Honolulu to implement flood mitigation in Manoa Valley pursuant to this Act.

     The sum appropriated shall be expended by the city and county of Honolulu for the purposes of this Act.

     SECTION 5.  This Act shall take effect on July 1, 2022.
