A BILL FOR AN ACT

 

 

RELATING TO SECTION 13 OF ACT 380, SESSION LAWS OF HAWAII 1997.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Act 380, Session Laws of Hawaii 1997, as amended by Act 3, Session Laws of Hawaii 2001, as amended by Act 90, Session Laws of Hawaii 2006, and as amended by Act 145, Session Laws of Hawaii 2012, is amended by amending section 13 to read as follows:

     "SECTION 13.  This Act shall take effect upon its approval; provided that no new safe harbor agreements, habitat conservation plans, or incidental take licenses issued pursuant to section 195D-4, 195D-21, or 195D-22, Hawaii Revised Statutes, shall be approved or issued on or after [June 30, 2017.] July 1, 2020."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Extends the sunset date on the use of new safe harbor agreements, habitat conservation plans, and incidental take licenses as recovery options for conserving and protecting the State's threatened and endangered species to July 1, 2020.  (HB2377 HD1)
