A BILL FOR AN ACT

 

 

RELATING TO PROFESSIONAL AND VOCATIONAL LICENSING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 436B, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§436B-    Licensure by endorsement; experience requirements.  Unless otherwise provided by law, an applicant for licensure by endorsement may demonstrate competency in a specific occupation or profession as determined by the licensing authority by rule in lieu of a requirement that the applicant has worked or practiced in that occupation or profession for a specified period of time prior to the application for licensure by endorsement.

     §436B-    Licensure; expedition of issuance; temporary permits.  (a)  Notwithstanding any law to the contrary, every licensing authority may establish by rule a procedure to expedite the issuance of a license, certification, or permit to perform services regulated by the licensing authority to a person:

     (1)  Who is certified or licensed to perform services in a state other than Hawaii;

     (2)  Whose spouse is a member of the armed forces of the United States;

     (3)  Whose spouse is the subject of a military transfer to Hawaii; and

     (4)  Who left employment to accompany the person's spouse to Hawaii.

     (b)  The procedure may include:

     (1)  Issuing the person a license, certificate, or permit if, in the opinion of the licensing authority, the requirements for licensure or certification of the other state are equal to, or greater than, the requirements of this State; or

     (2)  Developing a method to authorize the person to perform services regulated by the licensing authority in this State by issuing to the person a temporary permit for a limited period of time to allow the person to perform specified services while completing any requirements necessary for licensing or certification in this State that were not required in the state in which the person was licensed or certified."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2030.

Licensing; Military Spouses

 

Description:

Allows licensing boards to:  (1) allow applicants to demonstrate competency in lieu of work experience requirements; and (2) establish procedures to expedite the issuance of licenses, certifications, or permits to military spouses.  Effective July 1, 2030. (HB2257 HD1)
