A BILL FOR AN ACT

 

 

relating to shoreline setbacks.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the intent of shoreline setbacks is to establish a coastal-hazard buffer zone to protect beachfront development from high-wave events and coastal erosion.  Adequate setbacks allow the natural erosion and accretion cycles to occur and help maintain lateral beach access.  Shoreline setbacks also provide open space for the enjoyment of the natural shoreline environment.

     The legislature also finds that global warming, resulting in the dramatic rise of sea levels, is causing the erosion of beaches.  As a result, beachfront areas are receding at a rapid pace because current shoreline setbacks do not allow the natural erosion and accretion cycles to occur.

     The purpose of this Act is to allow for shoreline setbacks to include a distance that would avoid beachfront erosion.

     SECTION 2.  Section 205A-1, Hawaii Revised Statutes, is amended by amending the definition of "shoreline" to read as follows:

     ""Shoreline" means the upper reaches of the wash of the waves, other than storm and seismic waves, at high tide during the season of the year in which the highest wash of the waves occurs, usually evidenced by the edge of vegetation growth, [or] the upper limit of debris left by the wash of the waves[.], or the distance that would avoid beachfront erosion, whichever is greater."

     SECTION 3.  Section 205A-43, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  Setbacks along shorelines are established of not less than twenty feet and not more than forty feet inland from the shoreline[.], or the distance that would avoid beachfront erosion, whichever is greater.  The department shall adopt rules pursuant to chapter 91, and shall enforce the shoreline setbacks and rules pertaining thereto."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
