A BILL FOR AN ACT

 

 

Relating to the state budget.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Hawaii's nonprofit organizations are facing unprecedented economic obstacles in continuing to provide services to Hawaii residents.  As private funds diminish, public funding through the State's grant-in-aid process becomes even more vital to the stability of these organizations.  However, in response to decreases in state revenues, the governor has imposed restrictions on some appropriations, including grant appropriations.

     The purpose of this Act is to extend for one year the lapse date for appropriations made pursuant to Act 213, Session Laws of Hawaii 2007, for projects that qualify as a grant, pursuant to chapter 42F, Hawaii Revised Statutes.

     SECTION 2.  Act 213, Session Laws of Hawaii 2007, is amended by amending section 157 to read as follows:

     "SECTION 157.  Provided that any law or provision of this Act to the contrary notwithstanding, the appropriations made for capital improvement projects authorized under this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all appropriations made to be expended in fiscal biennium 2007‑2009 which are unencumbered as of June 30, 2010, shall lapse as of that date; provided further that this lapsing date shall not apply to:  (a) appropriations for projects described in section 125 of this Act where the means of funding is designated to be the state educational facilities improvement special fund, where such appropriations have been authorized for more than three years for the construction or acquisition of public school facilities; [and] (b) non‑general fund appropriations for projects described in section 125 of this Act where such appropriations have been deemed necessary to qualify for federal aid financing and reimbursement[.]; and (c) appropriations for projects described in section 125 of this Act where the project qualifies as a grant, pursuant to chapter 42F, Hawaii Revised Statutes, which shall lapse on June 30, 2011."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.


     SECTION 4.  This Act shall take effect on June 29, 2010.
