A BILL FOR AN ACT

 

 

relating to historic preservation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 6E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§6E-     Sale of undeveloped property.  (a)  Prior to advertising for sale or the sale, or long-term lease for a term in excess of ten years, of undeveloped property, the owner of the property or person responsible for the sale of the undeveloped property shall cause to be performed an archaeological inventory survey of the undeveloped property subject to the acceptance of the state historic preservation officer.  Any sites or resources found that may be eligible for the Hawaii registry of historic places shall be noted on a plan, prepared and filed in accordance with section 502-17, with the bureau of conveyances.  The archaeological inventory survey may include recommendations by the state historic preservation officer that portions of the undeveloped property may be unsuitable for future development and recommend that those portions of the undeveloped property be reclassified conservation or zoned by a county for preservation zoning.

     (b)  For purposes of this section, "undeveloped property" includes any:

     (1)  Real property;

     (2)  Situated in the State; and

     (3)  Upon which there are either no improvements or the infrastructure or improvements are subject to demolition and removal."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
