A BILL FOR AN ACT

 

 

relating to fishing.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 188, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§188-A  License for saltwater fish.  (a)  It shall be unlawful for any person to fish, take, or catch any saltwater fish for noncommercial purposes without first obtaining a license.

     (b)  The licenses may be issued by agents of the department upon written application in such form as may be prescribed by the department together with payment of a fee.  The fees for licenses and duplicate licenses shall be established by the department by rules adopted in accordance with chapter 91; provided that the fees shall be deposited into the special fund established under section 188-B.

     (c)  No person to whom a license has been issued under this section shall permit any other person to carry, display, or use the license for any purpose.  Every person to whom a license has been issued under this section shall show the license upon demand of any officer authorized to enforce the fishing laws of the State.  No person shall refuse any officer the examination or inspection of any bag or container of any kind used to carry saltwater fish or any vehicle or conveyance used to transport saltwater fish.

     (d)  The department may revoke any license for any infraction of the terms and conditions of the license.  Any person whose license has been revoked shall not be eligible to apply for another license until expiration of one year from the date of revocation.

     §188-B  Saltwater fish special fund.  (a)  There is established in the treasury of the State a special fund to be known as the saltwater fish special fund which shall be administered by the department.

     (b)  Moneys collected as fees for licenses issued under section 188-A shall be deposited into the saltwater fish special fund.

     (c)  The saltwater fish special fund shall be used to support the activities of enforcement officers of the department responsible for conservation and resources enforcement functions."

     SECTION 2.  In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2014.
