A BILL FOR AN ACT
relating to wildlife.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 183D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§183D- Reciprocity enforcement agreements. (a) The board may enter into a memorandum of understanding, agreement, or mutual aid compact with the head of any entity of another state, federal entity, or foreign entity for mutual assistance in enforcing compliance with hunting, fishing, and other wildlife laws in the respective jurisdictions.
(b) Employees of the department who are serving under the terms of a memorandum of understanding, agreement, or mutual aid compact entered into under subsection (a) shall be considered as performing services within their regular employment for purposes of compensation, employee benefits, workers' compensation, and any other rights or benefits to which they may be entitled as incidents of their regular employment.
(c) Employees of the department who are serving under the terms of a memorandum of understanding, agreement, or mutual aid compact entered into under subsection (a) retain personal immunity from civil liability and all rights of indemnification and representation incident to their regular employment.
(d) Pursuant to subsection (a), the board shall enter into the wildlife violators compact and shall make the provisions of the compact available through its rules.
(e) The board shall adopt rules to enforce the terms of a memorandum of understanding, agreement, or mutual aid compact entered into under subsection (a)."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
