A BILL FOR AN ACT

 

 

relating to product labeling.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 486, Hawaii Revised Statutes, is amended by adding a new section to part V to be appropriately designated and to read as follows:

     "§486-     Human cells; product labeling; requirements; penalties.  (a)  No person doing business in the State shall knowingly or intentionally expose any other person to a product developed or tested using human cells unless the product bears a warning label containing:

     (1)  A disclaimer that states that the product was developed or tested using one or more human cells; and

     (2)  The address of a website disclosing:

          (A)  The origin of each human cell that was used to develop or test the product was obtained;

          (B)  The method by which each human cell that was used to develop or test the product was obtained; and

          (C)  The medical or scientific name, if any, of the human cell base line that was used to develop or test the product.

     (b)  Any person that fails to comply with the requirements of this section shall be subject to a fine in amount not to exceed $          or imprisonment for a period not to exceed          , or both."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
