A BILL FOR AN ACT

 

 

RELATING TO THE LAND USE COMMISSION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that situations have arisen before the land use commission that have called into question certain commission members' conflicts of interest.  Under the state ethics code in chapter 84, Hawaii Revised Statutes, certain state employees, officials, and legislators are required to adhere to a standard of conduct when conducting business for the State.  As appointed state officials, land use commission members are subject to the state ethics code.  However, existing land use commission rules that govern the treatment of conflict of interest do not sufficiently provide proper guidance to handle certain situations.

     The purpose of this Act is to require the land use commission to amend its rules clarify the process for determining whether a conflict of interest exists.

     SECTION 2.  The land use commission shall amend its rules pursuant to chapters 84 and 91, Hawaii Revised Statutes, regarding its conflict of interest practices.  The amended rules pertaining to any parcel of land that is the subject of any issue or proposed action before the commission shall, at minimum:

     (1)  Clarify situations in which a commission member is required to contact legal counsel to determine whether the member is prohibited from voting or taking any official action;

     (2)  Specify the relationships that shall be disclosed and that shall prevent the commission member from voting or taking action; and

     (3)  Establish a process that specifically states the steps to determine whether a conflict of interest exists.

     SECTION 3.  This Act shall take effect upon its approval.
