A BILL FOR AN ACT

 

 

relating to school resource officers.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established within the department of law enforcement the resource officers in west Oahu schools pilot program.  The department of law enforcement shall work in partnership with the department of education to implement the program.

     (b)  The pilot program shall assign resource officers to high schools within the Campbell-Kapolei complex area to protect students.  Resource officers shall be armed in the same manner as a comparable law enforcement officer and authorized to conduct necessary safety protocols.

     (c)  Resource officers assigned under subsection (b) shall be trained for mass-shooting response and de-escalation.

     (d)  The department of law enforcement shall submit a report of its findings and recommendations regarding the resource officers in west Oahu schools pilot program to the legislature no later than twenty days prior to the convening of the regular session of 2027.  The report shall include:

     (1)  The cost of the program;

     (2)  The number of resource officers assigned to each school;

     (3)  The number of incidents addressed by the resource officers;

     (4)  A recommendation as to whether the pilot program should be terminated, amended, extended, or made permanent; and

     (5)  Any other information deemed relevant by the department of law enforcement or department of education.

     (e)  The pilot program shall cease to exist on June 30, 2027.

     SECTION 2.  In accordance with section 9 of article VII, of the Constitution of the State of Hawaii and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that the appropriation contained in this Act will cause the state general fund expenditure ceiling for fiscal year 2024-2025 to be exceeded by $          , or       per cent.  The reasons for exceeding the general fund expenditure ceiling are that the appropriation made in this Act is necessary to serve the public interest and to meet the needs provided for by this Act.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2024-2025 for establishing the resource officers in west Oahu schools pilot program, training resource officers, and assigning resource officers to high schools within the Campbell-Kapolei complex area.

     The sum appropriated shall be expended by the department of law enforcement for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2024.
