A BILL FOR AN ACT
RELATING TO ENERGY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
PART I
SECTION 1. The high technology development corporation, with the approval of the governor, is authorized to issue revenue bonds in the sum of $ or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2017-2018 for the development and construction of an electrolysis hydrogen production, storage, and dispensing facility to be managed by the Hawaii center for advanced transportation technologies.
SECTION 2. The revenue bonds authorized pursuant to section 1 of this Act shall be issued in the name of the high technology development corporation and in accordance with part III of chapter 39, Hawaii Revised Statutes.
SECTION 3. The sum appropriated shall be expended by the high technology development corporation of the department of business, economic development, and tourism for the purposes of this part.
SECTION 4. The authorization to issue revenue bonds under this part shall lapse on June 30, 2022.
PART II
SECTION 5. (a) There is established within the department of transportation a building energy efficiency demonstration project for building energy efficiency designs that assist the State in reaching net zero emissions.
(b) The department of transportation shall identify one state land site and construct a new state building or remodel an existing state facility to create a facility or building with net zero emissions. The department of transportation shall follow the United States Department of Energy's description of a Zero Energy Ready Home, which is a home with a renewable energy system that can offset all or most of its annual energy consumption. The department of transportation shall work with the department of business, economic development, and tourism to identify a site for construction or an appropriate existing state facility for remodeling.
(c) In developing, constructing, and maintaining the new state building or remodeled state facility pursuant to the guidelines established under subsection (b), the department of transportation and the department of business, economic development, and tourism shall conduct an analysis of the cost and benefits of adopting the building energy efficiency designs incorporated into the building or facility, including the fiscal consequences to the State and the related cost savings from energy efficiency. The department of transportation shall include payback periods of investment, taking into account the cost savings of the program. Building energy efficiency designs shall include but not be limited to the following when applicable:
(1) Lighter colored roofing material;
(2) Windows that use dynamic or electro chromatic glazing with the ability to change performance properties;
(3) Sensor-based lighting control systems;
(4) High efficiency ventilation or air conditioning units;
(5) Incorporation of natural light;
(6) Renewable energy systems; and
(7) Waste to energy conversion systems.
(d) The department of transportation shall submit a report to the legislature of the analysis conducted pursuant to subsection (c) no later than twenty days prior to the convening of the regular session of 2020.
SECTION 6. There is appropriated out of the general revenues of the State the sum of $ or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 to implement the building energy efficiency demonstration project.
The sums appropriated shall be expended by the department of transportation for the purposes of this part.
PART III
SECTION 7. Section 107-27, Hawaii Revised Statutes, is amended to read as follows:
"§107-27 Design of state buildings. (a) No later than one year after the adoption of rules under this chapter, the design of all state building construction shall be in compliance with the Hawaii state building codes, except state building construction shall be allowed to be exempted from:
(1) County codes that have not adopted the Hawaii state building codes;
(2) Any county code amendments that are inconsistent with the minimum performance objectives of the Hawaii state building codes or the objectives enumerated in this part; or
(3) Any county code amendments that are contrary to code amendments adopted by another county.
(b) Exemptions shall include county ordinances allowing the exercise of indigenous Hawaiian architecture adopted in accordance with section 46-1.55.
(c) For state buildings constructed or renovated on or after July 1, 2020, the design of state buildings shall encourage the use of natural light and incorporate the use of glass that uses a dynamic glazing system where appropriate.
As used in this subsection, "dynamic glazing system" means a glazing system that has the ability to reversibly change its performance properties."
PART IV
SECTION 8. New statutory material is underscored.
SECTION 9. This Act shall take effect on July 1, 2050; provided that section 5 shall be repealed on June 30, 2020; provided further that section 7 of this Act shall take effect on July 1, 2020.
