A BILL FOR AN ACT
relating to child support.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 571, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§571- Child support; separate order. (a) Notwithstanding any other law to the contrary, the court shall issue a separate child support order for each child and shall specify the amount to be paid for the support of each child.
(b) When the obligee is no longer eligible to receive child support payments as to a particular child, as provided by law, the child support order as to that particular child shall be automatically terminated."
SECTION 2. Section 576E-14, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) [The] Except as provided
in section 571- , the responsible parent, the agency, or the person having
custody of the dependent child may file a request for suspension, termination,
or modification of the child support provisions of a Hawaii court or
administrative order with the agency. Such request shall be in writing, shall
set forth the reasons for suspension, termination, or modification, including
the change in circumstances since the date of the entry of the order, and shall
state the address of the requesting party. The agency shall thereafter
commence a review of the order and, if appropriate, shall commence
administrative proceedings pursuant to sections 576E-5 through 576E-9. The
need to provide for the child's health care needs through health insurance or
other means shall be a basis for the agency to commence administrative
proceedings pursuant to section 576E-5."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
