A BILL FOR AN ACT

 

 

relating to youth sports.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to increase child safety relating to sports programs by establishing standards and regulations for youth sports coaches.

     SECTION 2.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

Youth Sports coach

     "§   -1  Definitions.  As used in this chapter:

     "Department" means the department of commerce and consumer affairs.

     "Youth sports coach" means a coach, Hawaii high school athletic association, or any nonprofit organization that organizes and charges a fee for participation.

     §   -2  Youth sports coach; training and certification required.  (a)  A youth sports coach shall obtain a certification, before teaching or training any athlete on the team in which the youth sports coach is coaching, from the governing sport league association and from the department.  Only one permit per year shall be required for a youth sports coach who coaches multiple teams.

     (b)  The department shall adopt rules pursuant to chapter 91 that establish requirements for youth sports coaches that include:

     (1)  Training requirements;

     (2)  Cardiopulmonary resuscitation and first aid training requirements;

     (3)  Concussion education requirements; and

     (4)  Background checks.

     §   -3  Permit; fees.  Any person desiring the permit required by section  -2 shall apply to the department for a permit on a form and in a manner prescribed by the department.  The permit shall be valid for one year.  The department may charge a reasonable permit processing fee.

     §   -4  Civil penalties.  Any person who violates any provision of this chapter or the rules adopted by the department pursuant to this chapter shall be fined not more than $1,000.  Each day of continued violation or failure to comply under this chapter shall constitute a separate offense.

     Unless otherwise expressly provided, the remedies or penalties provided in this chapter are cumulative to each other and to the remedies or penalties available under all other laws of this State."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  This Act shall take effect upon its approval.
