A BILL FOR AN ACT

 

 

relating to marriage.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 572, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§572-    Common law marriage.  (a)  Notwithstanding section 572-1(6) and (7) or any other law to the contrary, persons cohabiting and acknowledging each other as spouses, and generally reputed to be spouses, for a continuous period of not less than ten years subsequent to the effective date of this Act, shall thereafter be deemed to have been legally married.

     (b)  A marriage recognized as lawful pursuant to subsection (a) shall be subject to chapter 580."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
