A BILL FOR AN ACT

 

 

RELATING TO ANIMAL TRANSPORT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 142, Hawaii Revised Statutes, is amended by adding three new sections to be appropriately designated and to read as follows:

     "§142-A  Airline transport of pet animals or animals used for the pet trade.  (a)  No person shall transport a pet animal or an animal used for the pet trade by air cargo or baggage to, from, or within the State, except in compliance with this section and the Live Animals Regulations established by the International Air Transport Association and its member carriers.

     (b)  For shipments of pet animals or animals used for the pet trade, the shipper of the animal or the shipper's authorized agent shall:

     (1)  Provide food and water to the animal, if warmblooded, within two hours of delivery to the carrier, unless otherwise required by law or specified by International Air Transport Association species- specific regulations; and

     (2)  Complete a feeding and watering certification, in duplicate or by electronic form, documenting the date and time of the last feeding and watering and confirming compliance with paragraph (1), if applicable, for each animal.  One copy of the certification shall be attached to the top of the animal's container and the other copy to the air waybill.

     (c)  In addition to the requirements set forth in subsection (a), for shipments of a live non-domesticated wild bird, the shipper of the bird or the shipper's authorized agent shall complete a live wild bird certification, in duplicate or by electronic form, to accompany the air waybill, certifying that the live non-domesticated wild bird:

     (1)  Was born or bred in captivity on a special farm; or

     (2)  Is being shipped from or to a zoo, sanctuary, preserve, government wildlife agency, or rehabilitation center.

     (d)  Unless otherwise required by law, this section shall not apply to livestock or poultry animals that are not pets or are not used for the pet trade.

     §142-B  Transfer of pet animals or animals used for the pet trade from airline cargo hold.  (a)  Within twenty minutes of the block-in of an arriving aircraft, the carrier shall transfer pet animals or animals used for the pet trade from the cargo hold of the aircraft to the appropriate cargo holding or release area.

     (b)  The temperature of cargo holding or release areas where live pet animals or animals used for the pet trade are kept prior to loading or after unloading shall not exceed eighty-five degrees Fahrenheit.

     (c)  Unless otherwise required by law, this section shall not apply to livestock or poultry animals that are not pets or are not used for the pet trade.

     (d)  For purposes of this section, "block-in" means the moment the wheels of an arriving aircraft are stopped and chocked upon landing.

     §142-C  Minimum standard of care.  The standard of care pursuant to sections 142-A and 142-B for the airline transport and the transfer of pet animals or animals used for the pet trade are minimum standards and if a conflict exists between local, state, or federal laws, the law providing the most protection to the animals shall apply."

     SECTION 2.  In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
