A BILL FOR AN ACT

 

 

RELATING TO THE UNIFORM INFORMATION PRACTICES ACT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 92F, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§92F-    Complaints; disclosure and privacy.  (a)  Any agency that receives a consumer complaint and keeps a record of complaints shall make those complaints available to the public; provided that if the agency posts consumer complaints on the agency's website, it shall do so only if the agency:

     (1)  Has determined that one or more of the following requirements are met for each complaint:

         (A)  The complaint will be referred for legal action if legal action is authorized;

         (B)  The individual who is the target of the complaint has been provided an opportunity to respond to the complaint; or

         (C)  A probable violation of law has occurred or there is a possible risk of harm to the public;

         and

     (2)  Regularly updates and purges its website of posted consumer complaints that have been posted for at least four years from the initial filing of the complaint.

     (b)  For the purposes of this section, "consumer complaint" means any complaint arising from the purchase of any commodity or service from an entity or individual for which a license, registration, or certificate is required from the department of commerce and consumer affairs or any board or commission thereunder.

     (c)  An agency may establish rules pursuant to chapter 91 that define the information to be disclosed to the public; provided that the provisions of this chapter related to privacy shall apply to any information released to the public pursuant to this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2050.
