Florida Senate - 2013 (PROPOSED COMMITTEE BILL) SPB 7000 FOR CONSIDERATION By the Committee on Criminal Justice 591-00256-13 20137000__ 1 A bill to be entitled 2 An act relating to a review under the Open Government 3 Sunset Review Act; amending s. 741.313, F.S., which 4 provides a public records exemption for certain 5 records submitted to an agency by an employee who is a 6 victim of domestic violence or sexual violence; 7 eliminating the scheduled repeal of the exemption 8 under the Open Government Sunset Review Act; providing 9 an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Subsection (7) of section 741.313, Florida 14 Statutes, is amended to read: 15 741.313 Unlawful action against employees seeking 16 protection.— 17 (7)(a) Personal identifying information that is contained 18 in records documenting an act of domestic violence or sexual 19 violence and that is submitted to an agency, as defined in 20 chapter 119, by an agency employee under the requirements of 21 this section is confidential and exempt from s. 119.07(1) and s. 22 24(a), Art. I of the State Constitution. 23 (b) A written request for leave that is submitted by an 24 agency employee under the requirements of this section and any 25 agency time sheet that reflects such a request are confidential 26 and exempt from s. 119.07(1) and s. 24(a), Art. I of the State 27 Constitution until 1 year after the leave has been taken. 28(c) This subsection is subject to the Open Government29Sunset Review Act in accordance with s.119.15, and shall stand30repealed on October 2, 2013, unless reviewed and saved from31repeal through reenactment by the Legislature.32 Section 2. This act shall take effect October 1, 2013.
