1                        A bill to be entitled 
2         An act relating to applications for specified housing 
3         arrangements; amending s. 419.001, F.S.; requiring a 
4         sponsoring agency to notify the local government when 
5         a request to locate a home with six or fewer residents 
6         which otherwise meets the definition of a community 
7         residential home has been submitted; requiring the 
8         agency to provide additional information in the 
9         notification; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida: 
12 
13         Section 1. Subsection (2) of section 419.001, Florida 
14  Statutes, is amended to read: 
15         419.001 Site selection of community residential homes.— 
16         (2) Homes of six or fewer residents which otherwise meet 
17  the definition of a community residential home shall be deemed a 
18  single-family unit and a noncommercial, residential use for the 
19  purpose of local laws and ordinances. Homes of six or fewer 
20  residents which otherwise meet the definition of a community 
21  residential home shall be allowed in single-family or 
22  multifamily zoning without approval by the local government, 
23  provided that such homes shall not be located within a radius of 
24  1,000 feet of another existing such home with six or fewer 
25  residents. At the time of application, the sponsoring agency 
26  must notify the local government that there is a request to 
27  locate a home with six or fewer residents which otherwise meets 
28  the definition of a community residential home within the 
29  jurisdictional limits of the local government. The notification 
30  must include the proposed home’s address and Such homes with six 
31  or fewer residents shall not be required to comply with the 
32  notification provisions of this section; provided that, prior to 
33  licensure, the sponsoring agency provides the local government 
34  with the most recently published data compiled from the 
35  licensing entities that identifies all community residential 
36  homes within the jurisdictional limits of the local government 
37  in which the proposed site is to be located in order to show 
38  that no other community residential home is within a radius of 
39  1,000 feet of the proposed home with six or fewer residents. At 
40  the time of home occupancy, the sponsoring agency must notify 
41  the local government that the home is licensed by the licensing 
42  entity. 
43         Section 2. This act shall take effect July 1, 2010.
