1                        A bill to be entitled 
2         An act relating to transportation corporations; 
3         removing provisions that provide for nonprofit 
4         corporations to act on behalf of the Department of 
5         Transportation to secure and obtain rights-of-way for 
6         transportation systems and to assist in the planning 
7         and design of such systems; repealing ss. 339.401 
8         339.421, F.S., relating to the Florida Transportation 
9         Corporation Act, definition of terms used in the act, 
10         legislative findings and purpose, authorization of 
11         corporations, type and structure and income of 
12         corporation, contract between the Department of 
13         Transportation and the corporation, articles of 
14         incorporation, boards of directors, advisory 
15         directors, bylaws, notice of meetings and open 
16         records, amendment of articles of incorporation, 
17         powers of corporations, use of state property, 
18         exemption from taxation, authority to alter or 
19         dissolve corporation, dissolution upon completion of 
20         purposes, transfer of funds and property upon 
21         dissolution, department rules, construction of 
22         provisions, and issuance of debt; repealing s. 
23         11.45(3)(m), F.S., removing a provision for audits of 
24         transportation corporations by the Auditor General to 
25         conform; providing an effective date.

27  Be It Enacted by the Legislature of the State of Florida: 
28 
29         Section 1. Sections 339.401, 339.402, 339.403, 339.404, 
30  339.405, 339.406, 339.407, 339.408, 339.409, 339.410, 339.411, 
31  339.412, 339.414, 339.415, 339.416, 339.417, 339.418, 339.419, 
32  339.420, and 339.421, Florida Statutes, are repealed. 
33         Section 2. Paragraph (m) of subsection (3) of section 
34  11.45, Florida Statutes, is repealed. 
35         Section 3. This act shall take effect July 1, 2010.
