    2         An act relating to membership organization health
    3         coverage; creating s. 624.4032, F.S.; providing a
    4         short title; providing a purpose; defining the terms
    5         “farm bureau” and “not-for-profit membership
    6         organization”; providing that health coverage provided
    7         by certain entities is not insurance; authorizing
    8         risks under such coverage to be reinsured; requiring
    9         entities providing such coverage to annually file a
   10         certain statement; providing an effective date.
   11          
   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Section 624.4032, Florida Statutes, is created
   15  to read:
   16         624.4032 Farm bureau and not-for-profit membership health
   17  coverage.—
   18         (1)This act may be cited as the “Farm Bureau and Not-For
   19  Profit Membership Health Coverage Act of 2021.”
   20         (2)The purpose of this act is to allow not-for-profit
   21  membership organizations to offer new health coverage options to
   22  their members.
   23         (3)For purposes of this section, the term:
   24         (a)“Farm bureau” means a not-for-profit agricultural
   25  membership organization incorporated in this state, or an
   26  affiliate, designated as the state’s farm bureau.
   27         (b)“Not-for-profit membership organization” means a
   28  professional or trade association or any entity with dues-paying
   29  members which is exempt from federal income tax under section
   30  501(c) of the Internal Revenue Code and exists to serve its
   31  members beyond only offering health coverage.
   32         (4)Notwithstanding any law to the contrary, the health
   33  coverage provided by a farm bureau, a not-for-profit membership
   34  organization, or an agricultural cooperative association created
   35  under chapter 618 or chapter 619 is not insurance for purposes
   36  of the Florida Insurance Code.
   37         (5)The risk under health coverage provided pursuant to
   38  this section may be reinsured by a company authorized to
   39  transact reinsurance in this state.
   40         (6)A farm bureau, a not-for-profit membership
   41  organization, or an agricultural cooperative association
   42  providing health coverage pursuant to this section shall
   43  annually file with the office a signed, certified actuarial
   44  statement of plan reserves.
   45         Section 2. This act shall take effect January 1, 2023.
