Florida Senate - 2013 SB 1336 By Senator Thompson 12-01484-13 20131336__ 1 A bill to be entitled 2 An act relating to school personnel performance 3 evaluation; amending s. 1012.34, F.S.; revising 4 provisions relating to the measurement of student 5 learning growth for purposes of evaluating classroom 6 and nonclassroom instructional personnel; prohibiting 7 an employee from being penalized for unsatisfactory 8 performance based on certain student learning growth 9 data; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Paragraph (f) is added to subsection (7) of 14 section 1012.34, Florida Statutes, and subsection (8) of that 15 section is amended, to read: 16 1012.34 Personnel evaluation procedures and criteria.— 17 (7) MEASUREMENT OF STUDENT LEARNING GROWTH.— 18 (f) A classroom teacher shall be assigned a student 19 learning growth score based on valid and reliable statewide 20 assessments only for the students and subjects taught by the 21 teacher during the school year. Classroom teachers who teach 22 students or subjects not assessed by statewide assessments and 23 instructional personnel who are not classroom teachers may not 24 be assigned a student learning growth score based on students or 25 subjects that they did not teach. 26 (8) RULEMAKING.—The State Board of Education shall adopt 27 rules pursuant to ss. 120.536(1) and 120.54 which establish 28 uniform procedures for the submission, review, and approval of 29 district evaluation systems and reporting requirements for the 30 annual evaluation of instructional personnel and school 31 administrators; specific, discrete standards for each 32 performance level required under subsection (2) to ensure clear 33 and sufficient differentiation in the performance levels and to 34 provide consistency in meaning across school districts; the 35 measurement of student learning growth and associated 36 implementation procedures required under subsection (7); a 37 process to permit instructional personnel to review the class 38 roster for accuracy and to correct any mistakes relating to the 39 identity of students for whom the individual is responsible; and 40 a process for monitoring school district implementation of 41 evaluation systems in accordance with this section. 42 Specifically, the rules shall establish a student learning 43 growth standard that if not met will result in the employee 44 receiving an unsatisfactory performance evaluation rating, 45 except that an employee may not be penalized for unsatisfactory 46 performance if the student learning growth portion of the 47 evaluation is assigned based on students or subjects that the 48 employee did not teach. Similarly, an employee’s 3 years of 49 student learning growth data may not be used to penalize the 50 employee if any of the data is based on students or subjects 51 that the employee did not teach. In like manner, the rules shall 52 establish a student learning growth standard that must be met in 53 order for an employee to receive a highly effective rating and a 54 student learning growth standard that must be met in order for 55 an employee to receive an effective rating. 56 Section 2. This act shall take effect July 1, 2013.
