    2         An act relating to the board of directors of Florida
    3         ABLE, Inc.; amending s. 1009.986, F.S.; revising the
    4         composition of the membership of the Florida ABLE,
    5         Inc., board of directors; removing a limit on the
    6         number of terms that certain reappointed members may
    7         serve; providing an effective date.
    8          
    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (d) of subsection (3) of section
   12  1009.986, Florida Statutes, is amended to read:
   13         1009.986 Florida ABLE program.—
   14         (3) DIRECT-SUPPORT ORGANIZATION; FLORIDA ABLE, INC.—
   15         (d)1. The board of directors of Florida ABLE, Inc., shall
   16  consist of:
   17         a. The chair of the Florida Prepaid College Board, who
   18  shall serve as the chair of the board of directors of Florida
   19  ABLE, Inc.
   20         b. Up to three individuals One individual who possess
   21  possesses knowledge, skill, and experience in the areas of
   22  accounting, risk management, or investment management, one of
   23  whom may be a current member of the Florida Prepaid College
   24  Board, who shall be appointed by the Florida Prepaid College
   25  Board. A current member of the Florida Prepaid College Board,
   26  other than the chair, may be appointed.
   27         c. One individual who possesses knowledge, skill, and
   28  experience in the areas of accounting, risk management, or
   29  investment management, who shall be appointed by the Governor.
   30         d. Two individuals who are advocates of persons with
   31  disabilities, one of whom shall be appointed by the President of
   32  the Senate and one of whom shall be appointed by the Speaker of
   33  the House of Representatives. At least one of the individuals
   34  appointed under this sub-subparagraph must be an advocate of
   35  persons with developmental disabilities, as that term is defined
   36  in s. 393.063.
   37         2.a. The term of the appointees appointee under sub
   38  subparagraph 1.b. shall be up to 3 years as determined by the
   39  Florida Prepaid College Board. Such appointees appointee may be
   40  reappointed.
   41         b. The term of the appointees under sub-subparagraphs 1.c.
   42  and d. shall be 3 years. Such appointees may be reappointed for
   43  up to one consecutive term.
   44         3. Unless authorized by the board of directors of Florida
   45  ABLE, Inc., an individual director has no authority to control
   46  or direct the operations of Florida ABLE, Inc., or the actions
   47  of its officers and employees.
   48         4. The board of directors of Florida ABLE, Inc.:
   49         a. Shall meet at least quarterly and at other times upon
   50  the call of the chair.
   51         b. May use any method of telecommunications to conduct, or
   52  establish a quorum at, its meetings or the meetings of a
   53  subcommittee or other subdivision if the public is given proper
   54  notice of the telecommunications meeting and provided reasonable
   55  access to observe and, if appropriate, to participate.
   56         5. A majority of the total current membership of the board
   57  of directors of Florida ABLE, Inc., constitutes a quorum of the
   58  board.
   59         6. Members of the board of directors of Florida ABLE, Inc.,
   60  and the board’s subcommittees or other subdivisions shall serve
   61  without compensation; however, the members may be reimbursed for
   62  reasonable, necessary, and actual travel expenses pursuant to s.
   63  112.061.
   64         Section 2. This act shall take effect July 1, 2021.
