    1                        A bill to be entitled                      
    2         An act relating to insurance coverage for at-home
    3         COVID-19 test kits; creating s. 627.42398, F.S.;
    4         defining the term “at-home COVID-19 test kit”;
    5         requiring health insurers and health maintenance
    6         organizations to provide 100 percent coverage for at
    7         home COVID-19 test kits; providing for expiration of
    8         the insurance coverage; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 627.42398, Florida Statutes, is created
   13  to read:
   14         627.42398Coverage for at-home COVID-19 test kits.—
   15         (1)As used in this section, the term “at-home COVID-19
   16  test kit” means an over-the-counter diagnostic test kit that
   17  serves to detect active COVID-19 infections and for which the
   18  United States Food and Drug Administration has issued an
   19  Emergency Use Authorization. The term includes:
   20         (a)A COVID-19 self-collection kit, including, but not
   21  limited to, a polymerase chain reaction (PCR) test, which
   22  provides results after a sample is received by a lab.
   23         (b)A COVID-19 self-test kit, including, but not limited
   24  to, a rapid antigen test, which provides results in minutes.
   25         (2)A health insurer or health maintenance organization
   26  must provide 100 percent coverage for an at-home COVID-19 test
   27  kit that is purchased with or without a prescription, to be used
   28  at home or elsewhere.
   29         (3)This section expires December 31, 2023.
   30         Section 2. This act shall take effect upon becoming a law.
