A bill to be entitled
2An act relating to pharmacy and dietary services at
3assisted living facilities; amending s. 429.42, F.S.;
4deleting obsolete provisions relating to a corrective
5action plan and a requirement that two pharmacists assist
6with inspections at assisted living facilities under
7certain conditions; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Subsection (4) of section 429.42, Florida
12Statutes, is renumbered as subsection (2), and present
13subsections (2) and (3) of that section are amended to read:
14     429.42  Pharmacy and dietary services.-
15     (2)  A corrective action plan for deficiencies related to
16assistance with the self-administration of medication or the
17administration of medication must be developed and implemented
18by the facility within 48 hours after notification of such
19deficiency, or sooner if the deficiency is determined by the
20agency to be life-threatening.
21     (3)  The agency shall employ at least two pharmacists
22licensed pursuant to chapter 465 among its personnel who
23biennially inspect assisted living facilities licensed under
24this part, to participate in biennial inspections or consult
25with the agency regarding deficiencies relating to medicinal
26drugs or over-the-counter preparations.
27     Section 2.  This act shall take effect July 1, 2011.
