2An act relating to behavioral health services; amending s.
3394.9082, F.S.; providing an exemption for certain
4providers from participation in a community-based managing
5entity that provides behavioral health services; providing
6an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Paragraph (a) of subsection (4) of section
11394.9082, Florida Statutes, is amended to read:
12 394.9082 Behavioral health managing entities.-
13 (4) CONTRACT FOR SERVICES.-
14 (a) The department may contract for the purchase and
15management of behavioral health services with community-based
16managing entities. The department may require a managing entity
17to contract for specialized services that are not currently part
18of the managing entity's network if the department determines
19that to do so is in the best interests of consumers of services.
20The secretary shall determine the schedule for phasing in
21contracts with managing entities. The managing entities shall,
22at a minimum, be accountable for the operational oversight of
23the delivery of behavioral health services funded by the
24department and for the collection and submission of the required
25data pertaining to these contracted services. A managing entity
26shall serve a geographic area designated by the department. The
27geographic area must be of sufficient size in population and
28have enough public funds for behavioral health services to allow
29for flexibility and maximum efficiency. A provider located
30within a judicial circuit or other designated geographic area
31which demonstrates the capacity to fulfill the goals and
32essential elements set forth in subsections (5) and (6) shall be
33exempt from participating in a managing entity.
34 Section 2. This act shall take effect July 1, 2010.
