House Memorial
2A memorial to the Congress of the United States, urging
3Congress to take additional action to clarify and specify
4the Environmental Protection Agency's legal and regulatory
5obligations with respect to greenhouse gases.

7     WHEREAS, the Environmental Protection Agency has released
8an Advance Notice of Proposed Rulemaking that describes a
9nationwide plan to regulate greenhouse gases under the Clean Air
10Act, and
11     WHEREAS, the Environmental Protection Agency's plan to
12regulate greenhouse gases is very expansive in scope,
13envisioning a nationwide cap and trade program for greenhouse
14gases, additional motor vehicle regulations, and economy-wide
15restrictions impacting a wide range of industries, including
16dairy and beef operations, office buildings, hospitals, schools,
17large homes, and houses of worship, and even regulating the
18greenhouse gas emissions from lawnmowers, and
19     WHEREAS, the United States Court of Appeals for the
20District of Columbia Circuit has recently ruled that the
21Environmental Protection Agency does not have authority to carry
22out a cap and trade plan under the Clean Air Act, and
23     WHEREAS, the Environmental Protection Agency's plan
24represents policymaking that is the prerogative of the
25legislative branch, and
26     WHEREAS, even committed proponents of ambitious greenhouse
27gas regulation have expressed doubts about the Advance Notice of
28Proposed Rulemaking approach, and
29     WHEREAS, climate change is a global issue, not a local or
30regional pollution issue, which the Clean Air Act was designed
31to address, and
32     WHEREAS, the Environmental Protection Agency's plan would
33impose a massive economic burden on America without appreciably
34reducing worldwide concentrations of greenhouse gases, NOW,
35THEREFORE,

37Be It Resolved by the Legislature of the State of Florida:

39     That the Congress of the United States is urged to take
40additional action to clarify and specify the Environmental
41Protection Agency's legal and regulatory obligations with
42respect to greenhouse gases.
43     BE IT FURTHER RESOLVED that copies of this memorial be
44dispatched to the President of the United States, to the
45President of the United States Senate, to the Speaker of the
46United States House of Representatives, and to each member of
47the Florida delegation to the United States Congress.
