A bill to be entitled
2An act relating to public health; amending s. 381.0065,
3F.S.; delaying the implementation date of provisions
4requiring the Department of Health to administer an onsite
5sewage treatment and disposal system evaluation program;
6providing an effective date.
8Be It Enacted by the Legislature of the State of Florida:
10     Section 1.  Paragraph (a) of subsection (5) of section
11381.0065, Florida Statutes, is amended to read:
12     381.0065  Onsite sewage treatment and disposal systems;
15     (a)  Beginning July January 1, 2011, the department shall
16administer an onsite sewage treatment and disposal system
17evaluation program for the purpose of assessing the fundamental
18operational condition of systems and identifying any failures
19within the systems. The department shall adopt rules
20implementing the program standards, procedures, and
21requirements, including, but not limited to, a schedule for a 5-
22year evaluation cycle, requirements for the pump-out of a system
23or repair of a failing system, enforcement procedures for
24failure of a system owner to obtain an evaluation of the system,
25and failure of a contractor to timely submit evaluation results
26to the department and the system owner. The department shall
27ensure statewide implementation of the evaluation and assessment
28program by January 1, 2016.
29     Section 2.  This act shall take effect upon becoming a law.
