DELAWARE STATE SENATE

145th GENERAL ASSEMBLY

SENATE BILL NO. 222

AN ACT TO AMEND TITLE 23 OF THE DELAWARE CODE RELATING TO PILOTAGE RATES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend §131(a)(2), Chapter 1, Title 23, Delaware Code by striking paragraph (2) and substituting in lieu thereof the following:

"(2)The charges per unit shall be as follows:

Effective January 1, 2010 $12.36 per unit

Effective January 1, 2011 $12.36 per unit

Effective January 1, 2012 $12.61 per unit

Effective January 1, 2013 $12.86 per unit".

Section 2.Amend §131(a)(3), Chapter 1, Title 23, Delaware Code by striking paragraph (3) and substituting in lieu thereof the following:

"(3)There shall be a minimum charge of 200 units and a maximum unit charge as follows:

Effective January 1, 2010 1400 units

Effective January 1, 2011 1400 units

Effective January 1, 2012 1400 units

Effective January 1, 2013 1400 units".

Section 3.Amend §131(b)(2), Chapter 1, Title 23, Delaware Code by striking paragraph (2) and substituting in lieu thereof the following:

"(2)The charges per unit shall be as follows:

Effective January 1, 2010 $12.36 per unit

Effective January 1, 2011 $12.36 per unit

Effective January 1, 2012 $12.61 per unit

Effective January 1, 2013 $12.86 per unit".

Section 4.Amend §131(b)(3), Chapter 1, Title 23, Delaware Code by striking paragraph (3) and substituting in lieu thereof the following:

Effective January 1, 2010 1400 units

Effective January 1, 2011 1400 units

Effective January 1, 2012 1400 units

Effective January 1, 2013 1400 units".

SYNOPSIS

This Bill establishes the pilotage rates for the Pilot's Association for the Bay and River Delaware for 2011, 2012 and 2013.
