HOUSE BILL NO. 68

AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO ABANDONED PERSONAL PROPERTY


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Chapter 40, Title 25 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

(a) For the purposes of this chapter "abandoned personal property" shall be deemed to be tangible personal property which the rightful owner has left in the care or custody of another person and has failed to maintain, pay for the storage of, exercise dominion or control over, and has failed to otherwise assert or declare the ownership rights to the tangible personal property for a period of 1 year, or such shorter time as may be determined under this title following a writ of possession.


SYNOPSIS

As the law stands now, following a writ of possession, a Landlord must store a manufactured home of the tenant that was left unclaimed for 30 days.Following that 30-day period, the home is deemed abandoned by operation of law, and the Landlord may dispose of the home as the Landlord wishes.However, in order to acquire title to the home, the Landlord must wait 1 year under Chapter 40.This bill will permit the Landlord to acquire title following the 30 day waiting period.
