AN ACT TO AMEND TITLES 1, 4, 6 ,7, 10, 11, 12, 14, 16, 19,20, 21, 25,29, 30 AND 31 OF THE DELAWARE CODE RELATING TO THE REMOVAL OF INSENSITIVE AND OFFENSIVE LANGUAGE.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section1.Amend §302, Title 1 of the Delaware Code in paragraph (11) thereof by striking the phrase "‘Mentally ill person' includes every idiot, lunatic person, or person non compos mentis" and substituting in lieu thereof the phrase "‘Person with a mental condition' includes every person with an emotional or psychiatric disorder or disability" and reinserting new paragraph (11) in the appropriate location so as to preserve the alphabetical order of the definitional paragraphs in §302 and renumbering said paragraphs in sequential order.

Section.2.Amend §708(a)(3), Title 4 of the Delaware Code by striking the phrase "who is mentally ill or mentally deficient" as it appears therein and substituting in lieu thereof the phrase "with a mental condition or mental disability".

Section3.Amend subchapter VIII, Chapter 25, Title 6 of the Delaware Code in the title thereof by striking the phrase "or Disabled Person" and substituting in lieu thereof the phrase "Person or Person with a Disability".

Section4.Amend §2580(a), Title 6 of the Delaware Code by striking the phrase "Disabled person" as it appears therein and substituting in lieu thereof the phrase "Person with a disability".

Section 5.Further amend §2580(a), Title 6 of the Delaware Code by striking the phrase "handicap or" as it appears therein.

Section 6.Amend §2581(a), Title 6 of the Delaware Code by striking the phrase "elder or disabled persons" as it appears therein and substituting in lieu thereof the phrase "an elder person or a person with a disability".

Section7.Amend §2582(1), Title 6 of the Delaware Code by striking the phrase "or disabled person" as it appears therein and substituting in lieu thereof the phrase "person or person with a disability".

Section8.Amend §2582(2), Title 6 of the Delaware Code by striking the phrase "disabled person" as it appears therein and substituting in lieu thereof the phrase "person with a disability".

Section9.Amend §2582(3), Title 6 of the Delaware Code by striking the phrase "or disabled person" as it appears each time therein and each time substituting in lieu thereof the phrase "person or person with a disability".

Section 10.Amend §2582(4), Title 6 of the Delaware Code by striking the phrase "or disabled person" as it appears therein and substituting in lieu thereof the phrase "person or person with a disability".

Section 11.Amend §2582(4)b., Title 6 of the Delaware Code by striking the phrase "or disabled person" as it appears therein and substituting in lieu thereof the phrase "person or person with a disability".

Section 12..Amend §2582(4)c., Title 6 of the Delaware Code by striking the phrase "elder or disabled person's" as it appears therein.

Section 13.Further amend §2582(4)c., Title 6 of the Delaware Code by inserting after the phrase "source of income" but before the semicolon [;] the phrase "of the elder person or person with a disability".

Section 14.Amend §2582(4)f., Title 6 of the Delaware Code by striking the phrase "or disabled person" and substituting in lieu thereof the phrase "person or person with a disability".

Section 15.Amend §2583(a), Title 6 of the Delaware Code by striking the phrase "or disabled person" as it appears therein and substituting in lieu thereof the phrase "person or person with a disability".

Section 16.Amend §2583(b), Title 6 of the Delaware Code by striking the phrase "disabled person" as it appears therein and substituting in lieu thereof the phrase "person with a disability".

Section 17.Amend §2584, Title 6 of the Delaware Code by striking the phrase "or disabled persons" as it appears therein and substituting in lieu thereof the phrase "persons or persons with disabilities".

Section 18.Amend §502(i), Title 7 of the Delaware Code by striking the phrase "Blind persons" as it appears therein and substituting in lieu thereof the phrase "Persons who are blind".

Section 19.Amend §1009(b)(10), Title 10 of the Delaware Code by striking the phrase "mentally ill, retarded or disturbed child" as it appears therein and substituting in lieu thereof the phrase "child with a mental condition or child with an intellectual disability".

Section 20.Amend §1009(c)(10), Title 10 of the Delaware Code by striking the phrase "mentally ill, retarded or disturbed child" as it appears therein and substituting in lieu thereof the phrase "child with a mental condition or child with an intellectual disability".

Section 21.Amend §1009(e)(5), Title 10 of the Delaware Code by striking the phrase "conditions of mental illness or retardation" as it appears therein and substituting in lieu thereof the phrase "mental conditions or intellectual disabilities".

Section 22.Amend §1031(6), Title 10 of the Delaware Code by striking the phrase "a mentally ill, retarded, or disturbed adult" as it appears therein and substituting in lieu thereof the phrase "an adult with a mental condition or intellectual disability".

Section 23.Amend §1041(3)c., Title 10 of the Delaware Code by striking the phrase "infirm adult" as it appears therein and substituting in lieu thereof the phrase "adult who is impaired".

Section 24.Amend §1043(a), Title 10 of the Delaware Code by striking the phrase "infirm adult" as it appears therein and substituting in lieu thereof the phrase "adult who is impaired".

Section 25.Amend §6504, Title 10 of the Delaware Code by striking the phrase "mentally ill or insolvent" as it appears therein and substituting in lieu thereof the phrase "with a mental condition".

Section 26.Amend §8907, Title 10 of the Delaware Code in the title thereof by striking the phrase "deaf persons" and substituting in lieu thereof the phrase "persons who are deaf" and in the body thereof by striking the phrase "deaf person" as it appears each time therein and each time substituting in lieu thereof the phrase "person who is deaf".

Section 27.Amend §222 as effective until Sept. 1, 2011, Title 11 of the Delaware Code in subsection (18) by striking the phrase "Mental defect" as it appears therein and substituting in lieu thereof the phrase "Intellectual disability", striking the word "defective" as it appears therein and substituting in lieu thereof the phrase "a disability", and redesignating current subsection (18) as subsection "(14)" and renumbering current subsections (14), (15), (16) and (17) as "(15), (16), (17) and (18)", respectively.

Section 28.Amend §222 as effective Sept. 1, 2011, Title 11 of the Delaware Code in subsection (18) by striking the phrase "Mental defect" as it appears therein and substituting in lieu thereof the phrase "Intellectual disability", striking the word "defective" as it appears therein and substituting in lieu thereof the phrase "a disability", and redesignating current subsection (18) as subsection "(14)" and renumbering current subsections (14), (15), (16) and (17) as "(15), (16), (17) and (18)", respectively.

Section 29.Amend §222 as effective until Sept. 1, 2011, Title 11 of the Delaware Code in subsection (19) by striking the word "illness" as it appears therein and substituting in lieu thereof the word "condition".

Section 32.Amend §401(a), Title 11 of the Delaware Code by striking the phrase "mental illness or mental defect" as it appears therein and substituting in lieu thereof the phrase "a mental condition or psychiatric disorder".

Section 33.Amend §401(b), Title 11 of the Delaware Code by striking the phrase "mental illness or mental defect" as it appears each time therein and each time substituting in lieu thereof the phrase "mental condition or psychiatric disorder".

Section 34. Amend §401(c), Title 11 of the Delaware Code by striking the phrase "mental illness" as it appears each time therein and each time substituting in lieu thereof the phrase "mental condition".

Section 38.Amend §405, Title 11 of the Delaware Code in the title thereof by striking the phrase "becoming mentally disabled" and substituting in lieu thereof the phrase "developing a mental condition".

Section 39.Amend §405(a), Title 11 of the Delaware Code by striking the phrase "become mentally ill" as it appears therein and substituting in lieu thereof the phrase "developed a mental condition".

Section40.Further amend §406(a), Title 11 of the Delaware Code by striking the phrase "become mentally ill" as it appears therein and substituting in lieu thereof the phrase "developed a mental condition".

Section44.Further amend §408(a), Title 11 of the Delaware Code by striking the phrase "was in fact mentally ill" as it appears therein and substituting in lieu thereof the phrase "did in fact have a mental condition".

Section45.Further amend §408(a), Title 11 of the Delaware Code by striking the phrase "was mentally ill" as it appears therein and substituting in lieu thereof the phrase "had a mental condition".

Section46.Amend §408(b), Title 11 of the Delaware Code by striking the phrase "criminally mentally ill individuals" as it appears therein and substituting in lieu thereof the phrase "individuals with criminally mental conditions".

Section47.Further amend §408(b), Title 11 of the Delaware Code by striking the word "illness" as it appears each time therein and each time substituting in lieu thereof the word "condition".

Section48.Amend §408(c), Title 11 of the Delaware Code by striking the word "illness" as it appears therein and substituting in lieu thereof the word "condition".

Section51.Amend §453(2), Title 11 of the Delaware Code by striking the phrase "mental illness, mental defect" as it appears therein and substituting in lieu thereof the phrase "mental condition, psychiatric disorder".

Section 52.Amend §468, Title 11 of the Delaware Code by striking the phrase "incompetent person" as it appears each time therein and each time substituting in lieu thereof the phrase "person who is incompetent".

Section 53.Amend §841(c), Title 11 of the Delaware Code by striking the phrase "infirm adult" as it appears each time therein and each time substituting in lieu thereof the phrase "adult who is impaired" and further amend said subsection by revising the references therein to §3902(12) of Title 31 accordingly so as to reflect revisions made to §3902 of Title 31 elsewhere in this Act.

Section 54. Further amend §841(c), Title 11 of the Delaware Code by striking the phrase "disabled person" as it appears each time therein and each time substituting in lieu thereof the phrase "person with a disability" and further amend said subsection by revising the references therein to § 3901(a)(2) of Title 12 accordingly so as to reflect revisions made to §3901 of Title 12 elsewhere in this Act.

Section 55.Amend §1105(e), Title 11 of the Delaware Code by striking the phrase "infirm adult" as it appears therein and substituting in lieu thereof the phrase "impaired adult who is impaired".

Section 56.Amend §3516, Title 11 of the Delaware Code in the title thereof by striking the phrase "infirm adult" and substituting in lieu thereof the phrase "adult who is impaired".

Section 57.Amend §3516, Title 11 of the Delaware Code by striking the phrase "infirm adult" as it appears each time therein and each time substituting in lieu thereof the phrase "adult who is impaired".

Section58.Amend §3913(a), Title 11 of the Delaware Code by striking the phrase "is mentally retarded or mentally incapacitated" as it appears therein and substituting in lieu thereof the phrase "has an intellectual disability or is mentally incapacitated".

Section 59.Amend §4201(c) as effective until Sept. 1, 2011 and as effective Sept. 1, 2011, Title 11 of the Delaware Code by striking the phrase "Infirm Adult" as it appears therein and substituting in lieu thereof the phrase "Adult who is Impaired".

Section60.Amend §4209(d)(3)a., Title 11 of the Delaware Code by striking the phrase "was seriously mentally retarded" as it appears therein and substituting in lieu thereof the phrase "had a profound intellectual disability".

Section61.Amend §4209(d)(3)b., Title 11 of the Delaware Code by striking the phrase "alleged mental retardation" as it appears therein and substituting in lieu thereof the phrase "alleged intellectual disability".

Section382.Amend §5109(a), Title 31 of the Delaware Code by striking the phrase "be psychotic or mentally defective" and substituting in lieu thereof the phrase "have psychotic disorders or mental conditions".


SYNOPSIS

People First Language ("PFL") legislation is part of a national movement to promote dignity and inclusion for people with disabilities.PFL specifies that the order of terms used to describe any individual places the person first, and the description of the person second.For example, when using PFL, outdated terms such as "the disabled" would be phrased as "persons with disabilities."This language emphasizes that individuals are people first, and that their disabilities are secondary.

In compliance with PFL guidelines, this Act amends current references to persons with disabilities throughout the Code by placing the person first and the disability second.Also pursuant to PFL, this Act removes offensive and/or insensitive language from the Code and replaces that language with respectful language.For example, the Act replaces antiquated and offensive terms such as "mental retardation" and "mental illness" with more appropriate terms like "intellectual disability" and "mental condition," respectively.
