AN ACT PROPOSING AN AMENDMENT TO ARTICLE II, §13 OF THE DELAWARE CONSTITUTION RELATING TO IMMUNITY FROM ARREST. |
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1.Amend Article II, §13 of the Delaware Constitution by making deletions as shown by strike through and insertions as shown by underline as follows:
§13. Immunity from arrest and questioning of speeches.
Section 13. The Senators and Representatives shall, in
all cases, except treason, felony or breach of the peace, be privileged from
arrest during their attendance at the session of their respective Houses,
and in going to and returning from the same; and for any speech or debate
in either House they shall not be questioned in any other place.
SYNOPSIS
This Bill is the first leg of a constitutional amendment to remove a legislator's immunity from arrest in going to and returning from a session of their respective Houses. |
