Summary

As introduced, Bill 24-209 provides automatic sealing of non-conviction records without requiring an individual to file a motion or prove their innocence. It also provides for automatic sealing of records for eligible misdemeanor and felony convictions after a waiting period. Among other things it also clarifies that nonpayment of fines and fees does not prevent a sentence from being completed. The burden is on the prosecution to demonstrate why such relief should not be granted.
